Upon consideration thereof,
IT IS ORDERED THAT:
(1) The petition for panel rehearing is granted.
(2) The petition for rehearing en banc is denied.
(3) In view of the panel’s revised opinion, the court vacates the panel’s judgment and original opinion entered August 20, 2002, Harold L. Bowers v. Baystate Technologies, Inc., 302 F.3d 1334 (Fed. Cir. 2002).
